Poppet,

Yes you are right.

Many people in HK do have part time helpers, however many are breaking the law and it is a criminal offence with a custodial sentance if you are caught.

There are more people in prison for this than you would think.

The domestic helpers, when caught, are offered, and usually accept, a lighter sentance for giving evidance against the employer...

Many in Hong Kong do what is commonly known as 'sponsership' of an individual and this is infact illegal... The person asking to be 'sponsord' tells you it is perfectly acceptable and common practice. This is infact a lie. Anyone who 'sponsors' a domoestic helper, whereby they do anything apart from performing domestic duties in the apartment that is on the contract, is in breech of the immigration ordinance and is subject to a criminal conviction and 15 months in prison if you are caught.

Usually it is a neighbour that reports you etc or a maid is stoped in the street and asked for ID etc. When asked where they work they get caught...

On a brighter note, there is no shortage of people with perminaint HK ID Cards who are looking to work as part time domestic helpers. You can find lists of these on the HK Govt web sites. Also these people tend to be harder working, more reliable and cheaper...

Good luck.

30 years of hong kong case law and many instinces where I hear of some bleating person saying how unfair it is that their friend, husband, wife are i prison or have a criminal conviction and so have lost their job.

also heard of someone wanting a visa to usa and could not get it as they had a criminal conviction...

I was referring to your statement that local domestic helpers are harder working, more reliable and cheaper...
A rather sweeping statement with little or no basis in fact.
You'd think that 30 years of Hong Kong case law would have taught you to measure your statements more carefully...

O, you are asking how I know locals are harder working and more reliable? Yes I know this from the many people I know that choose to obide by the law and employ locas that they get from the labout department and other such institutions.

From your comment it seems you disagree, I take it you have had negative experinces with local domestics.

Nope. I am neither advocating that people break the law by hiring illegal workers, nor am I complaining about bad experiences with local workers.  I just picked up on your statement, which can easily be read to mean that foreign domestic helpers would as a rule be less reliable, work less hard and are more expensive.

I found that statement somewhat offensive, but felt I should ask what you what you based your statement on, before responding...

There is of course also quite a large contingent of foreign men and women in Hong Kong, who are available as domestic helpers/drivers/gardeners/assistants and the like, who are perfectly within their legal rights to work here, on account of their visa status (either because they are already PR's, or have a Dependant Visa).

It's a common misconception that all part-time foreign domestic helpers are illegal, which is obviously not always the case.  Given the level of English that I have experienced with local domestic helpers, this group may be an option for people who have yet to master Cantonese...

Yeah, I suppose your points are valid. I would however be amazed if more than 10% of non HK perm residents drivers are legal...

Zorro is right about the criminal nature of this offence and it's frowned upon by the courts. There's a certain Barrister (senior counsel in fact) in HK who has been convicted of this offence in the past. Escaped prison but certainly woke him up to what many consider a trivial matter. As he says criminal conviction means no visa for many countries including US and Australia. Bit harsh for just trying to hire cheap labour.

Not worth the risk so ask to see work permits and ID from potential employees. Don't just take their word for it the courts won't believe you.
